Pexly Legal Policy

This Legal Policy establishes the general legal framework governing your access to and use of the Pexly platform, website, applications, products, services, and related features.

By accessing or using Pexly, you acknowledge that you have read, understood, and agreed to comply with this Legal Policy and any other applicable policies or terms published by Pexly.

1. About Pexly

Pexly reserves the right to restrict, suspend, or terminate access where we reasonably believe that an account or activity violates applicable law, these policies, or creates a security or operational risk.

Products and services available through Pexly may be supplied or fulfilled by third parties.

Product descriptions, availability, specifications, prices, delivery estimates, warranties, and other information may originate from the applicable seller, supplier, manufacturer, or service provider.

Pexly aims to present information accurately but does not guarantee that all third-party information will always be complete, current, or error-free.

Where a third party is responsible for fulfillment or service delivery, certain aspects of the transaction may also be subject to that provider’s terms and policies.

5. Payments

Pexly may support payment methods and payment-processing services provided by third-party payment providers.

Payment processing may therefore be subject to the applicable payment provider’s terms, security procedures, verification requirements, and policies.

Pexly does not charge a general platform usage fee merely for using the platform.

Any applicable product price, shipping charge, payment-processing charge, conversion charge, or other transaction-related charge will be disclosed where applicable before the transaction is completed.

6. On-Chain Transactions

Where Pexly provides functionality involving blockchain or on-chain transactions, users understand that blockchain transactions are generally irreversible once confirmed on the applicable network.

Pexly does not charge a platform fee merely for using on-chain functionality unless expressly stated for a particular service.

However, blockchain networks may impose network or transaction fees that are determined by the applicable network and are outside Pexly’s control.

Users are responsible for verifying wallet addresses, network selections, transaction amounts, and other transaction details before confirming an on-chain transaction.

Pexly cannot guarantee the recovery of assets sent to an incorrect address or incompatible network.

7. Digital Assets and Financial Services

Pexly may provide functionality that interacts with digital assets or blockchain networks.

Unless expressly stated otherwise, Pexly does not represent that any digital asset will increase in value or provide a financial return.

Nothing on the Pexly platform should be interpreted as financial, investment, tax, or legal advice.

Users are responsible for determining whether a particular product, transaction, or service is lawful and appropriate for them.

8. Intellectual Property

Unless otherwise indicated, Pexly and its licensors own or control the intellectual property associated with the Pexly platform, including its software, branding, logos, designs, graphics, text, interfaces, and other original materials.

You may not copy, reproduce, modify, distribute, reverse engineer, sell, or commercially exploit Pexly’s proprietary materials without appropriate authorization.

Third-party trademarks, logos, product names, and intellectual property remain the property of their respective owners.

9. User Content

Where Pexly allows users to submit reviews, comments, images, listings, or other content, you are responsible for ensuring that the content you submit is lawful and does not infringe the rights of others.

You must not submit content that is fraudulent, deceptive, abusive, defamatory, unlawful, malicious, or infringing.

By submitting content to areas of the platform intended for public or shared display, you grant Pexly the permissions reasonably necessary to host, display, reproduce, and distribute that content in connection with operating the relevant service.

10. Privacy

Pexly may collect and process information necessary to operate its services, process transactions, provide customer support, maintain security, and comply with applicable legal obligations.

The handling of personal information is governed by Pexly’s Privacy Policy.

Users should review the applicable Privacy Policy for information about how personal information is collected, used, stored, and disclosed.

11. Security

Pexly takes reasonable measures to protect its platform and users.

However, no internet-based service, software system, payment system, or transmission method can be guaranteed to be completely secure.

Users are responsible for protecting their account credentials, wallet information, authentication methods, and other security information.

You should immediately notify Pexly if you believe your account has been compromised.

12. Availability of the Platform

Pexly may modify, suspend, restrict, or discontinue portions of the platform or particular services at any time.

We do not guarantee that the platform will always be available, uninterrupted, error-free, or compatible with every device or software environment.

Maintenance, updates, security measures, third-party service interruptions, and circumstances outside Pexly’s reasonable control may affect availability.

13. Disclaimers

To the maximum extent permitted by applicable law, Pexly provides the platform and its services on an “as available” basis.

Pexly does not guarantee that:

The platform will always operate without interruption
Information will always be completely accurate or error-free
Products or services will always remain available
Third-party services will operate continuously
Delivery times will always be met
Blockchain transactions will be confirmed within a particular period

Nothing in this Legal Policy excludes rights or protections that cannot legally be excluded under applicable law.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Pexly will not be liable for indirect, incidental, special, consequential, or punitive losses arising from or related to your use of the platform.

This may include losses arising from service interruptions, third-party services, delivery delays, unauthorized access, blockchain network conditions, or circumstances beyond Pexly’s reasonable control.

Nothing in this section limits liability that cannot legally be limited or excluded.

15. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Pexly and its affiliates, officers, employees, contractors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from:

Your violation of this Legal Policy
Your unlawful use of the platform
Your violation of another person’s rights
Fraudulent or unauthorized activity associated with your use of the platform
Content you submit to the platform

16. Third-Party Links and Services

Pexly may contain links, integrations, or connections to third-party websites, services, payment providers, marketplaces, blockchain networks, or other external systems.

Pexly does not control third-party services and is not responsible for their content, availability, security, policies, or practices.

Your use of a third-party service may be governed by that provider’s own terms and policies.

17. Compliance With Law

You are responsible for complying with all laws and regulations applicable to your use of Pexly.

Pexly may take measures necessary to comply with legal requirements, prevent fraud, protect users, protect the platform, or respond to lawful requests from authorities.

18. Changes to This Policy

Pexly may update this Legal Policy periodically.

When changes are made, the updated policy will be published on the Pexly platform and the “Last Updated” date will be revised.

Your continued use of Pexly after an updated policy becomes effective constitutes acceptance of the revised policy to the extent permitted by applicable law.

19. Severability

If any provision of this Legal Policy is determined to be invalid, unlawful, or unenforceable, that provision will be limited or removed to the minimum extent necessary, while the remaining provisions will continue to apply.

20. Entire Agreement

This Legal Policy, together with Pexly’s applicable Terms and Conditions, Privacy Policy, Refund Policy, Shipping Policy, and other published policies, forms part of the agreement governing your use of Pexly.

Where different policies apply to a specific service or transaction, the policy specifically addressing that service or transaction may apply to the extent of any inconsistency.
